HOW TO FILE A COMPLAINT
A complaint can be submitted verbally (by
telephone), in writing, or in person. There
is an informal and formal complaint process.
Informal: an informal complaint process
is one that is initiated and conducted by the Director of Human
Resources or designee. Efforts at informal resolution need
not include an investigation unless the Director of Human Resources or
President determine that an investigation is warranted by the
seriousness of the charges.
Formal: a formal process requires that
the complainant submit the complaint using the
Unlawful Discrimination Complaint Form. A formal
investigation will be
conducted by the NOCCCD 504 / Title II Compliance Coordinator, or designee, in accordance with the procedures set forth by the North Orange County Community College District
(AP3430).
Advisements:
1) You need not participate in an informal
resolution if you do not desire to do so;
2) You have the right to file a formal
complaint as described in Section 4.0 of AP3430;
3) If the complaint is not employment based,
you have the right to file a complaint with the Office for Civil
Rights of the U.S. Department of Education where such a complaint is
within that agency's jurisdiction;
4) If the complaint is employment based, you
have the right to file a complaint with the U.S. Equal Employment
Opportunity Commission (EEOC) and/or the Department of Fair
Employment and Housing (DFEH) where the complaint is within the
jurisdiction of those agencies;
5) If you choose to handle your complaint
through an informal resolution, it does not extend the time
limitations for filing a formal complaint.

Students, prospective students, employees and job applicants are protected from intimidation, coercion, interference, or discrimination for filing complaints or assisting in the investigation of a complaint under all applicable federal and state laws and regulations, including:

Management and supervisory level employees
Supervisors must take immediate steps to end situations of
discrimination and sexual harassment when it is brought to their
attention. Advice and assistance are available from the Office of
Equity and Diversity.
As a recipient of federal funding, Fullerton College maintains a comprehensive and current
Equal Employment Opportunity (EEO) Plan and Student Equity Plan.
These strategic planning documents will guide the success of
diversity initiatives for the campus community. The EEO
Plan is available for review at the North Orange County Community
College District office located at 1830 W. Romneya Drive, 9th
Floor, Anaheim, CA 92801. The Student Equity Plan is
available for review in the Office of Equity and Diversity located
in Rm. 128.
The Office of Equity and Diversity is the "front
door" for all complaints of discrimination and sexual harassment.
If after conducting an investigation of the charges, the Director of
the Office of Equity and Diversity, determines that discipline
is warranted, the case is referred to the appropriate administrative
officer for disciplinary action.
It is unlawful to knowingly file a false complaint.
